Motorcycle rental contract

These General Terms and Conditions of Sale set out the rules for the rental and use of motorcycles as part of the Rider Maroc service.

Rider Maroc, a motorcycle rental service with an accompanying guide, is marketed by KA-Solutions (France) and operated by Konexia (Marrakech).

1. KA-Solutions company (France)

The company KA-Solutions, 4 rue de la République, 69.001 Lyon, RCS Lyon : 903 096 279 000 18, puts online and operates the website www.rider-maroc.com available worldwide in several languages.

2. Konexia company (Marrakech)

KA-SolutionsThe company Konexia, 240 Lot Al Massar, Marrakech, Morocco, RC :11 3149 provides the technical means (motorcycles and assistance) and guides within the framework of the rental contracts signed between the customer and KA-Solutions, via the website www.rider-maroc.com.

3. Billing and collection

Daily motorcycle rental contracts and stays are invoiced and cashed by credit card by the KA-Solutions company via the www.rider-maroc.com website.

Optional all-risk equipment insurance policies are offered to the pilot, invoiced and cashed by credit card via the www.rider-maroc.com website or on site in Marrakech before departure.

The www.rider-maroc.com website is a platform offering organized motorcycle tours over one or more days, as well as complete multi-day stays.

4. General Sales Conditions - Scope of application

The present General Terms and Conditions of Sale apply to all visitors and users of the www.rider-maroc.com platform and to all content offered. Booking and ordering the tours or stays offered automatically implies compliance with and acceptance of these General Terms and Conditions of Sale.

5. Driver behavior

KA-Solutions and its representative Konexia reserve the right to cancel the participation of any pilot or passenger in the event that the conduct or actions of the said person jeopardize the smooth running of the ride, or infringe the rights or well-being of the other members of the group.

If a rider or passenger is excluded from a ride during or just before its start for reasons of inappropriate behaviour, no refund will be given.

6. Rules concerning alcohol and drugs

It is forbidden to arrive at the start of a ride intoxicated or under the influence of alcohol.

It is strictly forbidden to consume illegal drugs or alcohol during a ride.

7. Weather conditions

The organizer cannot be held responsible for unforeseen changes in weather conditions, and offers no refund in the event of a change in weather conditions during the tour.

If the weather forecast is poor (rain) for the day of the tour, the organizer may cancel the tour, in which case the customer will be offered a full refund or the possibility of rescheduling the tour to another date.

If weather conditions change unexpectedly during the ride, the organizer may modify the route and/or shorten the ride in progress for safety reasons, without any right to partial reimbursement.

8. Route modification

Although the itineraries of the rides are perfectly defined, the organizer may modify them to improve the safety conditions of the ride (in case of road works or other deterioration of the road circuit due to bad weather).

9. Stroll guide

All rides are supervised by a professional guide who is fully trained in motorcycle riding and knows the route of the ride.

The guide always leads the procession, and overtaking is strictly forbidden.

It is compulsory for riders and passengers to follow and respect all instructions given by the guide before or during the ride.

10. Departure briefing

Before starting the ride, the guide will clearly give you all the safety instructions and advice you need to drive safely in Moroccan traffic.

The guide will determine the order of riders in the procession, with the least experienced riders placed by the guide directly behind his motorcycle.

All drivers must respect the order defined by the guide throughout the day.

A detailed presentation of the bikes will be given by the guide in the morning, and riders are asked to ask him any questions they may have if they have any doubts about an explanation or function of the bikes.

11. Material damage - Customer's liability

The customer will be held responsible for any damage caused by his negligence when using the motorcycle, up to a maximum of €1,500 (One Thousand Five Hundred Euros).

Une caution Visa ou Mastercard (pré-autorisation) de 1 500 euros est demandée avant le départ.

This deposit will be released at the end of the day or at the end of the stay once the motorcycle has been found to be undamaged.

In the event of damage, the cost of repairs will be deducted from the credit card used to block the deposit, and the remainder of the deposit will be released.

Prior to departure, the rider must choose to take out the standard comprehensive insurance contract or opt for an insurance extension reducing the deductible to 500 Euros, and sign the list of main parts indicating the amount of their change in the event of breakage.

12. Motorcycle tours - Risks

Motorcycle tour participants are fully aware of the inherent risks and dangers and accept full responsibility for them.

Customers are solely responsible for any damage caused to a third party and waive all claims against the organizer, its representatives and employees for any personal damage suffered during the tour. Any complaints and/or claims must be brought immediately to the attention of the logistics manager and cannot be taken into consideration at a later date.

Any dispute will be judged by a competent Moroccan court.

13. Mechanical breakdowns - Delays

The organizer declines all responsibility for any delays caused by breakdowns and necessary repairs to motorcycles or transport and assistance vehicles during a ride.

14. Registration - Conditions

Once the reservation has been confirmed and payment made on the www.rider-maroc.com website, the rider can immediately go online to complete the registration procedure, which is essential if the Konexia teams are to validate the rider's profile and prepare the ride and motorcycle.

If the registration procedure is not completed online after purchase, the pilot can complete his registration at a later date.

After payment, the pilot receives an e-mail with his invoice and a personalized link to complete the registration procedure. By clicking on this link, he can complete the registration procedure.

If more than one driver has been declared in the booking, each driver must complete the registration procedure.

During the registration process, the driver(s) must download the following items:

  • 1 – Copy of passport
  • 2 – Copy of driver's license showing entitlement to drive motorcycles
  • 3 – Copy of travel insurance with medical repatriation and telephone number of repatriation assistance service
  • 4 – Disclaimer (form attached at the bottom of these Terms and Conditions)

15. Travel insurance with medical repatriation

As indicated in the registration procedure, a copy of a travel insurance certificate with repatriation cover is absolutely essential.

This insurance must cover all medical care, hospitalization and possible repatriation for any accident occurring abroad.

The organizer will refuse to accept any rider who cannot provide proof of such insurance on the day of departure, with no possibility of reimbursement if such proof is not provided by the morning of the ride's departure.

If the rider has repatriation and medical abroad insurance linked to his/her credit card, he/she must provide a copy of the card's special conditions attesting to his/her coverage abroad.

The telephone number of the claims handling service must be legible on the documents submitted.

16. Driver's license - Protections

Riders must hold an unrestricted motorcycle license (A for Euro zone) from their country of residence.

The driver assumes all responsibility for compliance with the regulations in force in Morocco.

Drivers should follow the guide's instructions to adapt their driving style to Moroccan traffic conditions.

Helmets are compulsory. If the rider does not have his own helmet, Konexia will provide one on the morning of departure, as well as a pair of gloves if desired.

Rides are carried out on routes selected to ensure maximum safety, and no additional equipment is required. The rider may bring other personal equipment suitable for motorcycle riding.

The customer undertakes to follow the instructions given by the guide and the Konexia team during the daily briefings and throughout the ride.

17. Medical advice

It is advisable to make a preventive medical check-up by informing your doctor of your participation in a motorcycle tour in Africa, where temperatures are higher than in Europe.

Riders with pre-existing medical problems should bring them to the attention of Konexia staff before the start of the ride.

Should a rider feel ill during the ride or before departure, he/she must report this immediately, so that we can arrange for medical evacuation or consultation. Konexia cannot be held responsible for any medical incidents suffered during the ride.

18. Property damage - Liability

Konexia provides each rider with a motorcycle in perfect working order at the start of the tour.

Should the motorcycle become unusable due to an accident or negligent use, a second motorcycle will not be provided.

As stated in article 11 of these General Terms and Conditions of Sale, the customer agrees to assume all costs incurred by damage to motorcycles or motorcycle equipment resulting from an accident and/or negligent or careless use of the motorcycle, up to a liability limit of  1.500 €.

The value of damaged mechanical parts or equipment will be determined by reference to the price of the item in question on the manufacturer's price list with a 40% mark-up to cover shipping and customs clearance costs and a 20% mark-up for import VAT.

 A list of major parts with replacement costs will be provided to customers before each departure.

19. All-risk property damage insurance

At the time of registration, or at the time of final check-in, or on the morning of the start, the driver can take out comprehensive insurance against material damage.

Drivers will be offered two levels of insurance:

  • Insurance A - Comprehensive insurance with a deductible of €1,500
  • Insurance B – Comprehensive with a deductible of 500 €

20. Services included

Included in the tour prices:

The motorcycle, fuel, logistical and mechanical assistance, helmet and gloves, lunches, coffee and tea breaks, welcome breakfast.

The following are included in the price of your stay:

Accommodation in double (couples) or single rooms

Full board + services included on all tours.

All transfers during the stay are included in our rates.

21. Prestations non incluses

Airfare, beverages (alcohol, soft drinks, etc.), room service charges, activities on days off, except those included in the 'stay' offers, which form part of our itinerary, any personal items, passport and visa fees, fines and gratuities, laundry charges, telephone and fax calls, personal insurance (medical and repatriation), any additional excursions.

22. Payment - Deposit

At the time of ordering, the pilot can decide on the www.rider-maroc.com website whether to pay the full amount or only 50% of the deposit, or the amount of the deposit indicated on the quotation.

For all tours, the balance of the order can be paid on site at the latest by credit card or in cash (Euros or Dirhams) on the morning of departure.

Under no circumstances will the rider be allowed to take part in a ride if the service has not been paid in full on the morning of departure.

To simplify check-in procedures on the morning of departure, we strongly recommend that all pilots settle their order before the day of departure. 

In the case of partial payment for a tour or a stay of several days, the rider will receive an email 30 days before the date of the tour inviting him to pay the balance.

If the balance is not paid within 10 days of the reminder email being sent, the order will be payable on site on the day of departure. If the customer does not show up, the order will be considered cancelled and the deposit will not be refunded.

23. Cancellation conditions

In the event of cancellation by the pilot more than 20 days before the date of the ride, the reservation deposit will be refunded, with the exception of an administration fee of €60 per pilot and €20 per passenger per day.

In the event of cancellation by the rider, less than 20 days before the date of the ride, no refund will be made, and the deposits or sums paid will be retained.

Upon presentation of valid proof of cancellation, the rider may ask customer service to postpone the ride to a later date, in which case the sums paid will be retained to the rider's credit for 12 months.

After this 12-month period, in the absence of another reservation, the sums will be forfeited.

In the event of cancellation by the organizer for reasons of force majeure or bad weather, the organizer will propose an alternative date or a full refund.

24. Video and photo reports

The organizer reserves the right to film or take photographs of all these tours and stays and to use these films and photographs for promotional purposes, to promote sales, in brochures and for any other commercial purpose.

25. Price

The prices indicated on the www.rider-maroc.com website are inclusive of VAT (as the services are invoiced by a French company for car/motorcycle rides carried out in Morocco, outside Europe, no VAT is applied).

26. Day D - Appointment and pick-up of pilots

Apart from special arrangements subject to a specific quote, the meeting point for all short rides (excluding stays or raids) is at the Rider Maroc base one hour before departure time. The base address will be communicated to the customer with the invoice and reminded by e-mail and SMS 48 and 24 hours before departure.

If the rider's contact details change from those provided during the registration phase, it is the rider's responsibility to contact our customer service department (by e-mail, chat or telephone) to indicate any changes to his/her e-mail address or telephone number.

Any final formalities and information checks will be carried out on our premises before we take the bikes out for the ride.

For multi-day stays and raids, pilots will be picked up directly at the airport the day before the stay or raid, at the arrival time indicated by the customer during the check-in procedure (unless the pilot informs customer service to the contrary).

Riders must leave a means of communication (telephone, e-mail, WhatsApp) operational in the days prior to the date of the ride, so that they can be contacted by our customer service department if necessary.

27. Other rights of the organizer

The organizer of the tour may cancel it on the scheduled date without having to observe a cancellation period if weather conditions, administrative measures, strikes or other external circumstances which cannot be foreseen or which can only be avoided by the deployment of disproportionate efforts by the organizer of the activity and which do not fall within his sphere of influence, in particular events of force majeure, make it impossible to carry out the tour or make it considerably more difficult or jeopardize it. In such cases, the booking fee paid for the cancelled activity will be refunded.

The ride organizer may decide to exclude a rider or passenger if he or she fails to meet the required conditions of participation, or if his or her participation constitutes an obvious risk to himself or herself or to others, or if he or she disrupts the ride in any way. In such cases, the reservation price paid for the tour or stay will not be refunded.

28. Applicable law

By express agreement between the parties, these General Terms and Conditions of Sale are governed by and subject to French law.

29. Disputes

In the event of a dispute concerning an order, the parties will first seek to reach an amicable agreement or a mediation or conciliation procedure.
